SERVICIOS NC4, S.A. DE C.V. (“SERVICIOS NC4”), with domicile in Monterrey, Nuevo León, and contact email address: serviciosnc4@gmail.com, is the responsible party for the use and protection of the Personal Data of the Holders contained in the Documents.

 

This Privacy Notice is issued in compliance with the Federal Law on the Protection of Personal Data Held by Private Parties and its respective Regulations; terms with an initial capital letter will have the meaning attributed to them in the body of this document. For the purposes of this Privacy Notice, the term “Holder” includes the following individuals: (i) the individuals who provide us with their contact details in the contact form contained on our website, (ii) the individuals who directly deliver a Document to us containing their own Personal Data for the purpose of providing Services to them, and (iii) the individuals whose Personal Data appear in a Document that has been delivered to us, by any means, by a third party (an individual or legal entity) for the purpose of providing Services to such third party, so it shall be understood that such individual indirectly provided us with their Personal Data. The term “Document” is defined as: (i) the contact form contained on our website, or (ii) any written instrument that appears in any support (whether physical, electronic or other) that is delivered to us, by any means, for the purpose of providing the Services, regardless of whether said document is public or private. “Services” is defined as the legal counseling services and/or document translation services provided by SERVICIOS NC4 or any of its associates.

 

Given the nature of the Services we provide, the Documents may contain all types of personal data, including identification data, contact data, employment data, academic data, asset and financial data, health data and sensitive personal data in all its categories (collectively, the “Personal Data”).

 

The Personal Data we collect from the Holders are used solely to (i) respond to contact requests through our website, (ii) provide the Services requested from us and in accordance with the scope required by the client in the provision of Services, (iii) regarding legal services and to the extent that it is applicable to us, comply with the provisions of the Federal Law for the Prevention and Identification of Operations with Illicit Proceeds, and (iv) only in certified translation services, the full name of the client is included in the biannual report that the expert translator who certifies said translation is required to submit in accordance with the provisions of the Organic Law of the Superior Court of Justice of the State of Nuevo León.

 

We commit ourselves to restrict the treatment of the Personal Data of the Holders (including its collection, use, disclosure, storage, access, handling, exploitation, transfer or disposition to processors and to third parties) to the fulfillment of the purposes mentioned above. By accepting this Privacy Notice, it shall be understood that the Holder gives his/her consent for such treatment, unless there is a written communication in which the Holder states his/her refusal to the treatment of his/her Personal Data. It is our commitment to take special care regarding the personal information of Holders who are minors, by implementing and maintaining security measures to ensure the confidentiality of the Personal Data of these people.

 

Every Holder has the right to know what Personal Data is held about him/her, for what purpose they are used, and the terms of their use (access). Likewise, it is his/her right to request the correction of his/her personal information if it is outdated, inaccurate or incomplete (rectification); to have it removed from our records or databases when the Holder believes it is not being used in accordance with the principles, duties and obligations set forth in the regulations (cancellation); and to oppose the use of his/her Personal Data for specific purposes (objection). Additionally, any Holder can revoke the consent, that if applicable, he/she has given for the treatment of his/her Personal Data; however, it is important to take into account that we may not be able to immediately attend to this request or terminate its use, as it is possible that, due to a legal obligation, we may need to continue using such Personal Data; provided further that, it is possible that the revocation may mean that we can no longer continue offering or providing the Services requested. The exercise of the aforementioned rights will be made through a written request sent by email to serviciosnc4@gmail.com. The request must contain such necessary information that allows the proper accreditation of the identity of the respective Holder, as well as the necessary information that allows the location of the Personal Data (including the name of the client who requested the Service and the approximate date on which the Document containing said Personal Data was delivered). We commit ourselves to respond to your request within a period no longer than 15 business days by making the Personal Data available to the Holder.

 

If you consider that your right to the protection of your Personal Data has been infringed by any conduct or omission on our part, you may file your complaint or claim with the National Institute for Transparency, Access to Information and Personal Data Protection (INAI). Your delivery to us of any Document for the provision of a Service (including its delivery for quotation purposes, even if the Service is not finally commissioned with us), constitutes and will be interpreted as (1) your acceptance of the terms of this Privacy Notice, in regards to the treatment of Personal Data of the respective Holder or Holders, including sensitive personal data, contained in said Document, (2) your acceptance of the provisions set forth in the last sentence of this paragraph, and (3) your acceptance and submission to the exclusive jurisdiction of the competent courts located in the city of Monterrey, Nuevo León, Mexico, for the resolution of any controversy related to the use and treatment of the Personal Data of the respective Holder or Holders. Any individual or legal entity who delivers to us a Document containing Personal Data of a third party, simply by its delivery represents and guarantees that such third party has authorized to such individual or legal entity to transfer their Personal Data to us, unless: (i) such Document is a public document according to the law, or (ii) such Document is delivered for the proper provision of Services to exercise a right or file an action according to the law by the individual or legal entity who delivers us such Document.
